Maybe so and that someone may be me one day. But I would be interested to see what happens when you get that ticket and go in front of the local marine council to discuss it. Will they throw it out since it is the disputed zone? or will they assess a fine as if you were fishing out of season.I will be willing to bet someone in these disputed waters will probably be made an example of when it comes to red snapper...If I had to guess the coast guard will probably receive orders from up above to patrol these areas and do some checks.
You won't go to the local court/judges if you get caught in THEIR federal waters..it will be in federal court if you decide to fight it. Since the feds don't recognize the new state boundaries...how do you think that federal judge will rule??? If you did decide to appeal and take it to a higher court..by the time you paid lawyers and court cost's etc..it will be cheaper to pay the 2000.00 . definitely a no win situation ..not worth the risk for 2 snapper. jmho.Maybe so and that someone may be me one day. Do you have a link or other details on that? Did they get ticketed from the Coast Guard and if so did they get a letter/fine statement from a federal magestrate (I believe the Coast Guard citations here go into St. Petersburg).$500 per fish. I know 2 boats that have got them this year.
I dont know much other than they were both written up by the coast guard. One was down in south la. And the other i think was stopped crossing fed water coming back from la into ms. A good friend of mine got ticketed by the coast guard before katrina..SE of chandeleur..he had to go to federal court in new orleans. I can just about guarantee you the fine will be more than 250. 500 a fish sounds about right. And contrary to some beliefs, the coast guard has and will write tickets on fish size and limits.That's the other problem with these state seasons for MS, AL and LA. They states open up these state season in these "disputed" areas and tell the fisherman that they are fishing at their own risk. However, they don't tell you what they risk is. If people knew what the fine was, then you could make a better decision. I have heard everything to a flat $250 fine for just the boat owner/captain if you are caught with any out of season snapper (regardless of the quantityt) up to $1000s of dollars of fines for everyone on board.
